FTC takes Microsoft case to appeals in last minute filing

The Federal Trade Commission has filed an appeal to the recent ruling against them which enables the Microsoft acquisition of Activision-Blizzard to proceed.

The FTC brought forth an emergency motion shortly after Judge Corley further refused additions to the case brought forth by the FTC.


The emergency motion was filed late on Thursday, and includes arguments by the FTC on why the deal must be delayed to “allow the Court time to consider whether the FTC’s appeal is meritorious”.

The motion also includes justification for why it could not have been filed earlier, but some commenters believe it to be disingenuous.

The motion notably requests a “stay” for the duration of the appeal, which could tie up the Microsoft deal for another couple months, causing Microsoft’s bid to overstay the July 18 deadline before renegotiation.
