ToeJam and Earl was long a classic Sega franchise, and its third iteration was set for release on the Sega Dreamcast, before the platform met its untimely fate. The game was then ported to the original Xbox, where it met mediocre reviews and sales.

A hobbyist bought a used Sega Dreamcast and realized that it had had an early beta for ToeJam and Earl 3: Mission to Earth on it a while ago, and pleaded his case to the owners of the IP: could he publish it online? ToeJam and Early Productions obliged, saying that as long as he didn’t profit from the release, it would be fine, although they emphasized that the property still belonged to Sega.
